A local business owner filed last month a complaint alleging two Burkett Outdoor Advertising digital banners in downtown San Antonio broke state ethics laws. Jim Persons filed the complaint, who supports the downtown ballpark project.

The business owner claims that the signs were in violation of state law because they do not include a TEC right-of-way notice and did not disclose information on the ads about the fact that Tim Benson purchased the ad space. The business owner also says that the ads do not clearly state that they are paid for by the campaign.
TEC Rejects Complaint by Businessowner
Persons, who owns an agency of insurance, filed a complaint Oct. 12, but it was rejected by TEC. In a statement, the commission claimed that the complaint was based in technical errors.
In its rejection letter, the TEC cited "simple errors" in the information on the ads. The TEC stated that the information in the ads stating Benson bought the ad space was difficult to read and did not include a TEC right of way statement as required under law.
These errors may not be serious, but it is open to debate. The TEC did no respond to reporter inquiries on Wednesday.

Unconstitutional is the City's Sign Ordinance
The underlying legal issue in this case is the constitutionality of a City ordinance that requires Salter to obtain permits to install off-premises advertising signs. Salter specifically challenges the City's municipal ordinance (the "Ordinance"), which governs the location, size and setback of outdoor advertising signs. The court is charged with determining whether or not the Ordinance is valid as applied. The court must decide if the Ordinance discriminates against commercial or noncommercial advertisements.
